General

Lyme Bay Holidays Limited is the agent acting on behalf of the owner/s of the properties advertised on this website. When booking a property you enter into a contract with the owner/s of the property. 

Lyme Bay Holidays are responsible for the administration of this booking. We will try as far as possible to resolve any problems that may occur but any dispute relating to the property/holiday itself will be a matter directly between you and the owner. The conditions stated here are the basis of the said contract.

Booking Conditions

The contact name and person booking online must be over 21 years of age and agrees to be responsible for the party occupying the property and is authorised to agree to all conditions of hire on behalf of all members of the party.

No booking is binding until confirmed in writing by Lyme Bay Holidays Ltd. Confirmed bookings are not transferable between properties.

When booking please ensure that you check any points of particular interest to your party e.g. distance from facilities, locations, number of steps, traffic noise etc.

We do try to assist to ensure that you have chosen the most suitable property for your party but the ultimate responsibility is yours – if you are unsure about any aspect of your selection please phone us for advice before booking.  We reserve the right to refuse to accept bookings at our discretion where we believe that such a booking would not be in the best interests of the owner and/or the holidaymaker.

We are unable to accept bookings from all male or female parties of more than three people unless by special arrangement – please call us before booking.

All bookings are accepted on the clear understanding that the property is taken for holiday purposes only and is not used for any other purposes and must be vacated by the agreed time and date. You will be liable for any costs incurred for unauthorised extension of tenancy.

The number of people occupying the property must not exceed the number shown on the confirmation or that advertised as maximum on the website. All party members must be named on the booking. The owners and Lyme Bay Holidays Ltd reserve the right to refuse admission or enter the property and end the tenancy if the numbers exceed as above. A charge will be made for any extra persons.

Payments

If the booking is made six or more weeks before the holiday commences a deposit of one-third of the total cost plus the booking fee is required.

Deposits paid are not refundable unless the conditions of the cancellation plan are met.

Once the booking has been received and receipted in writing by Lyme Bay Holidays Ltd the balance will be due six weeks before the holiday commences. If the balance payment has not been received six weeks prior to the arrival date Lyme Bay Holidays Ltd reserve the right, after taking all reasonable steps to contact the holiday party, to re-sell the holiday and the holiday will be treated as a cancellation under the terms of the plan.

Any charges raised against Lyme Bay Holidays Ltd by their bank for dishonoured cheques, bank transfers and non-sterling cheque payments will be passed on to the booking party and payment for these charges must be made within 5 working days.

Lyme Bay Holidays Ltd will not cover the cost of any charges incurred by the booking party for our bank requesting re-presentation, referral to drawer or refusal of cheques paid to Lyme Bay Holidays Ltd.

Any payments made by Credit card will incur a surcharge of 2%.

A few properties require a security deposit to be in place with Lyme Bay Holidays Ltd before occupation. If this is the case it is clearly stated in the property details.

A security deposit of £200 is required for all Christmas and New Year bookings.

Lyme Bay Holidays Ltd reserve the right to change prices quoted due to errors or omissions.

VAT where applicable is included in the prices shown at the standard rate at the time of going to print. Lyme Bay Holidays Ltd reserves the right to adjust this should legislation require.

Responsibility

Owner/s are responsible for providing holiday accommodation in a clean and tidy condition taking all reasonable steps to ensure that all facilities advertised are provided.

The hirers of the property must ensure that the property is left in a clean and tidy condition — failure to do so will result in an additional charge.

The hirers of the property are responsible for the replacement of any article broken or damaged during their occupation of the property and for the repair of any damage done to the property itself (excluding reasonable wear and tear).

Where swimming pools are included as part of the facilities in a holiday property it is on the understanding that they are un-supervised and that it is your responsibility to ensure that children and non-swimmers are supervised at all times.

Liability

Lyme Bay Holidays Ltd, their staff/representatives, do not accept any liability for any neglect, default or act on the part of the owners nor for any inconvenience, injury, accident or loss suffered by any person or to any vehicle or possessions in or about the properties or in any way arising out of these properties from any cause whatsoever.

Lyme Bay Holidays Ltd aim to ensure that the details provided by owners for inclusion on this website are correct.  We cannot accept responsibility for errors contained on the website or for any mis-description made by us as a result of inaccurate information given to us by an owner or modifications made by the owner without our knowledge.  Any changes to facilities/ descriptions that we are informed of and that may materially affect the stay will be notified to you as quickly as possible.

Lyme Bay Holidays Ltd can not be held responsible for any changes or the withdrawal of properties from this website.

If for any reason the property booked becomes unavailable or is deemed unsuitable for letting by Lyme Bay Holidays Ltd, all monies paid will be refunded in full and this is the extent of the liability of Lyme Bay Holidays Ltd and the owner/s, no further claims will be acknowledged.

Lyme Bay Holidays Ltd and/or the owner/s of the property booked do not accept any liability for any disruption of tenancy due to surrounding or neighbouring properties of any sort whatsoever. This is to include building works, impairment of views and noise.

Lyme Bay Holidays Ltd and/or the owner/s of the property do not accept liability or pay any compensation where a property becomes unavailable due to ‘force majeure’. This describes any event which Lyme Bay Holidays Ltd and/or the owner/s could not avoid. These events are to include storm or weather damage, criminal damage, break- in, explosion, fire, flood, which causes destruction or damage to the property making the property not satisfactory for letting. Also included are adverse weather conditions, riots, industrial action, civil strife, natural disasters, nuclear disasters, oil spills, war or threat of war, actual or threatened terrorist activity and all similar situations beyond Lyme Bay Holidays Ltd or the owner/s control.

Local Events etc.

If for any reason, any advertised local event, services or facilities become unavailable, Lyme Bay Holidays Ltd will not hold any responsibility or entertain any requests for compensation.

Complaints

All complaints should be notified to our office immediately. We will not entertain a complaint once a property has been vacated. Lyme Bay Holidays Ltd and the property owners reserve the right to investigate and resolve any problems during tenancy without refund or compensation.

Any complaints submitted in writing will be forwarded to the owners for a final resolution.

Pets

Pets, when allowed, in properties must be kept under control and in no circumstances left alone in the property nor allowed onto furniture or beds. Hirers take full responsibility for any pets brought to the property and agree to pay a surcharge of £20.00 per pet per week (or part week). ‘No pets’ in the brochure description does not guarantee that a pet (including the owners) would not have been at the property.

Lost property

We can accept no responsibility for items left behind in the property after you have vacated. We will charge a £15.00 admin fee plus the cost of postage in advance to retrieve and return lost property on request.  Any unclaimed items of property will be disposed of after 4 weeks.

Termination of Contract

If the booking party fail to adhere to any of the conditions set out above, Lyme Bay Holidays Ltd and the property owner/s reserve the right to enter the property and terminate the tenancy.

Cancellations

No extra charge is made for this plan.

  • Lyme Bay Holidays Ltd must be telephoned or emailed immediately you are aware you cannot take your holiday.
  • All cancellations must be notified in writing within four working days of notification of your cancellation, giving details of the reason for the cancellation along with a doctor’s letter or other supporting documents as required.
  • Holidays can only be cancelled under the scheme up to 2 days before the day of your arrival. All holidays cancelled after this time will not be covered
  • The cancellation plan is operated by Lyme Bay Holidays Ltd whose decision is final.
  • Where a cancellation is covered by the plan, full repayment will be made less £30, the booking fee and any credit card surcharge paid.
  • Cover - Death, injury, serious illness of any member of the party or close relative; jury service of any member of the party; posting of any member of the party in the armed services.
  • Exclusions - Pregnancy; death/injury/illness as a consequence of a condition known or occurring prior to booking; any member of the party (or relative causing the cancellation) aged 70 years or over at the time of travel; government regulations; strikes; war; revolution; domestic disputes; bad weather; disinclination to travel;change of employment; changes to leave by employer.
  • In the event of a cancellation not being covered by the plan, Lyme Bay Holidays Ltd will use their best endeavours to re-book the holiday on your behalf and will refund the amount paid less the booking fee; any discount given to sell the holiday; the £30 administration charge and any credit card surcharge paid. Any such refund will not be forthcoming until after the end of the holiday date.
  • In any event the full balance must be paid by the due date where a cancellation is not covered by the cancellation plan.
  • Retrospective claims will not be entertained.
  • If you require comprehensive medical/cancellation cover, we strongly advise that you take out separate independent travel insurance.
